All Short term rentals accept our terms of service

Terms of Service

1. Agreement to These Terms

These Terms of Service / Vacation Rental Terms and Conditions (“Terms”) form a legally binding agreement between the person making the reservation, all persons occupying or entering the Property through or under that reservation, and the Owner, Host, Property Manager, and their agents, employees, contractors, successors, assigns, affiliates, and representatives (collectively, the “Owner”).

By making a reservation, paying for a reservation, checking into the Property, entering the Property, or permitting any other person to enter the Property, Guest agrees to these Terms on behalf of Guest and every occupant, invitee, visitor, child, and any other person Guest allows onto the Property.

Guest represents and warrants that Guest:

  1. is at least twenty-five (25) years old, unless the booking platform or Owner expressly states a different minimum age in writing;
  2. has the legal authority to enter into this agreement;
  3. will personally occupy the Property during the rental term unless expressly authorized otherwise in writing by Owner;
  4. has provided truthful, complete, and accurate booking, occupancy, contact, identity, and payment information; and
  5. accepts full responsibility for compliance by all occupants and visitors with these Terms.

If Guest does not agree to all Terms, Guest may not book, occupy, or use the Property.

2. Nature of Occupancy; No Tenancy Created

The Property is offered strictly as a short-term transient accommodation and not as a residence, leasehold, tenancy, or long-term dwelling.

No landlord-tenant relationship is intended or created by this agreement. Guest acknowledges that the booking is for transient occupancy only, subject to all applicable local transient occupancy rules, platform rules, and applicable law.

Guest shall have no right to remain in possession of the Property beyond the agreed checkout date and time. Any stay beyond checkout is a material breach.

3. Reservation Eligibility and Primary Guest Responsibility

The person who makes the reservation is the “Primary Guest.” The Primary Guest is fully responsible for:

  • all rent, fees, taxes, penalties, chargebacks, losses, fines, damages, claims, and costs;
  • the conduct of all occupants and visitors;
  • ensuring all occupants and visitors understand and comply with these Terms;
  • supervising all minors at all times; and
  • the truthfulness of all information provided before, during, and after the reservation.

The Owner may require identity verification, proof of age, a signed short term rental agreement, a guest list, vehicle information, and emergency contact information at any time before or during the stay.

The Owner may cancel, refuse check-in, or terminate occupancy if Guest provides false, misleading, incomplete, or unverifiable information.

4. Booking Platforms; Conflict of Terms

If the reservation is made through Airbnb, VRBO, Booking.com, or another platform, these Terms apply in addition to the platform terms. If a conflict exists, the Owner may elect whichever provision is more protective of the Owner to the maximum extent permitted by law, except where non-waivable law requires otherwise.

Guest remains liable to Owner even if the platform declines to collect, reimburse, or enforce a claim.

5. Payment; Authorization; Chargebacks

All rental charges, taxes, cleaning fees, extra guest fees, pet fees, security deposits, damage waivers, and any additional charges are due as stated at booking or as otherwise invoiced by Owner.

Guest authorizes Owner and/or the booking platform to charge the payment method on file for:

  • rent and taxes;
  • approved add-ons;
  • late checkout charges;
  • unauthorized early check-in charges;
  • extra cleaning;
  • smoking remediation;
  • odor remediation;
  • trash removal;
  • pool, spa, slide, diving board, or fire feature misuse cleanup or repair;
  • damages of any kind;
  • missing items;
  • pest treatment caused by Guest;
  • emergency response costs caused by Guest;
  • fines, penalties, HOA charges, municipal penalties, towing, or neighbor claim amounts caused by Guest;
  • attorneys’ fees and collection costs to the extent permitted by law.

Chargebacks filed in bad faith or contrary to these Terms constitute a material breach. Guest remains liable for all amounts owed plus related collection expenses, administrative costs, and reasonable attorneys’ fees where recoverable by law or contract.

6. Taxes

Guest agrees to pay all applicable taxes, assessments, district charges, and government-imposed lodging charges associated with the stay.

If the Property is located in Goleta, rentals of 30 consecutive days or less may be subject to applicable transient occupancy taxes and related district assessments as required by local law. If taxes are under-collected by the booking platform or otherwise become due because of Guest’s reservation, Guest remains responsible for payment.

7. Security Deposit; Damage Authorization

Owner may require a security deposit, incidental hold, or damage authorization before check-in. Owner may use such deposit or authorization to cover, without limitation:

  • physical damage;
  • missing inventory;
  • excessive cleaning;
  • policy violations;
  • unauthorized occupancy;
  • unauthorized pets or events;
  • pool contamination;
  • fire feature misuse;
  • smoking, vaping, or drug odor remediation;
  • key, lock, garage remote, gate remote, access device, or re-key charges;
  • fines, citations, penalties, or third-party charges caused by Guest.

Any deposit does not limit Guest’s liability. If costs exceed the deposit, Guest must immediately pay the balance upon demand.

8. Check-In, Check-Out, Access, and Holdover

Check-in time: as agreed in writing
Check-out time: as agreed in writing

Early check-in or late checkout is not allowed unless approved in writing.

Guest shall fully vacate the Property by checkout time, including removal of all persons, vehicles, trash, and belongings. If Guest fails to depart by checkout:

  1. Guest authorizes Owner to enter the Property;
  2. Owner may remove, store, or secure Guest’s property as permitted by law;
  3. Owner may change locks, codes, or access credentials;
  4. Guest may be charged holdover fees of $[insert amount] per hour and/or one full additional night or more, whichever is greater;
  5. Guest is liable for all consequential damages, including refunds, relocation expenses, and lost revenue involving incoming guests;
  6. Guest agrees that Owner’s written booking confirmation and these Terms serve as written notice that timely departure is mandatory.

Guest expressly acknowledges that the Property may be reserved for an arriving guest immediately after checkout and that timely departure is an essential condition of this agreement.

9. Maximum Occupancy; Visitors; Unauthorized Persons

Maximum overnight occupancy is strictly limited to as agreed in writing persons.
Maximum daytime visitors is strictly limited to as agreed in writing persons.
No person may be on the Property unless disclosed, approved, and compliant with all occupancy limits.

Unauthorized persons, undisclosed guests, or excess occupancy are material breaches and may result in:

  • immediate termination of the reservation without refund;
  • extra guest fees;
  • increased cleaning fees;
  • security intervention;
  • municipal, HOA, or neighbor complaint charges;
  • removal from the Property.

At Owner’s request, Guest must provide a complete guest list and government-issued identification for adult occupants.

10. No Parties; No Events; No Commercial Use

No party, reception, wedding, photo shoot, filming, recording session, social gathering, promoted gathering, business event, or commercial use is permitted unless Owner gives prior written consent.

“Party” and “event” are defined broadly and include any gathering that exceeds the approved occupancy, disturbs neighbors, increases risk, uses amplified sound, adds rentals/vendors, or materially increases wear, parking, noise, trash, or liability.

Violation may result in immediate termination without refund, immediate removal, and additional fees.

11. Quiet Enjoyment; Neighborhood Protection

The Property is located in a residential or mixed neighborhood. Guest must behave respectfully at all times.

Quiet hours are from 9pm to 8am, and stricter quiet behavior may be required at any time if noise can be heard outside the Property line, in the street, or by neighboring properties.

Guest shall not:

  • create unreasonable noise;
  • use amplified outdoor music or speakers unless expressly allowed in writing;
  • yell, scream, sing loudly, or engage in disruptive behavior outdoors;
  • trespass onto neighboring property;
  • block driveways, sidewalks, or emergency access;
  • interfere with neighbors’ quiet enjoyment.

Any complaint from neighbors, HOA, law enforcement, code enforcement, security, or the booking platform may be treated as evidence of breach.

12. Parking; Vehicles; Towing

Parking is allowed only in designated areas identified by Owner. No street parking, lawn parking, RV parking, trailer parking, or commercial vehicle parking is allowed unless expressly authorized in writing.

Guest shall not charge electric vehicles from any outlet or charging equipment unless the Property specifically authorizes it.

Unauthorized vehicles may be towed at Guest’s sole risk and expense.

13. No Illegal Activity; Compliance With Law

Any suspected illegal activity may be reported to law enforcement, platform safety teams, insurers, regulators, HOA, or other authorities.

14. Entry by Owner; Inspection; Emergency Access

Owner may enter the Property as allowed by law, including for emergency response, safety issues, urgent repairs, suspected rule violations, property protection, maintenance, compliance inspections, pest treatment, utility service, pool or fire safety concerns, or to prevent injury or property damage.

In emergencies, entry may occur without prior notice. In non-emergencies, reasonable notice may be provided as required by law.

Guest shall not interfere with inspection, maintenance, emergency response, or compliance-related access.

15. Safety Is Guest’s Responsibility

Guest acknowledges that no property can be made risk-free. Guest is solely responsible for using reasonable caution and for supervising all occupants and visitors, especially:

  • children;
  • non-swimmers;
  • elderly persons;
  • persons with disabilities or reduced mobility;
  • intoxicated persons;
  • persons using medications that impair judgment or coordination.

Guest accepts that amenities such as stairs, decks, tiles, wet surfaces, pool areas, patios, outdoor furniture, BBQs, fireplaces, fire pits, pool slides, diving boards, gates, and driveways can be dangerous if used improperly.

Guest understands that pool, spa, slide, and diving board use involves obvious and non-obvious risks, including catastrophic injury or death, and voluntarily accepts those risks for Guest and all persons entering under Guest’s reservation, to the fullest extent permitted by law.

17. Fire Pit, Fireplace, BBQ, and Open-Flame Terms

  10. If Owner designates a wood-burning feature as prohibited, Guest shall not use it under any circumstances. Owner may require that only propane or natural-gas fire features be used.

18. No Smoking; No Vaping; No Drugs

Smoking, vaping, e-cigarettes, cigars, cannabis smoking, incense, hookah, and any similar activity are prohibited inside the home and prohibited anywhere else on the Property except in a specifically designated area, if any, identified by Owner in writing.

Evidence of smoke, vapor, ash, odor, residue, burns, or discarded smoking materials may result in substantial remediation charges, extra cleaning fees, ozone treatment, duct treatment, upholstery treatment, lost-rent damages, and immediate termination.

Children must be supervised at all times. No child may ever be left unattended:

  • in the pool area;

21. Condition of Property; Guest Inspection Duty

Guest shall inspect the Property promptly upon arrival and notify Owner immediately of any cleanliness issue, maintenance issue, safety concern, or mismatch with booking expectations.

If Guest uses the Property or any amenity without promptly reporting a condition, Guest is deemed to have accepted the condition as satisfactory except for latent issues Guest could not reasonably discover.

Guest shall not attempt repairs, move heavy furniture, alter equipment, reprogram systems, or hire contractors without written permission.

22. Inventory; Furnishings; No Rearranging

Furniture, décor, electronics, remotes, mattresses, safety devices, pool equipment, covers, games, linens, kitchen inventory, and all other contents must remain in their assigned locations unless Owner expressly approves otherwise.

Missing or damaged contents will be charged at replacement cost, shipping, installation, setup, lost-use, and administrative handling rates.

24. Exterior Cameras, Noise Monitoring, and Security Devices

To protect the Property, Owner may use lawful exterior security cameras, doorbell cameras, gate cameras, driveway cameras, parking cameras, and privacy-compliant noise monitoring devices in exterior/common areas.

No camera is located inside private interior living spaces, bedrooms, bathrooms, or other areas where a reasonable person expects privacy.

Guest may not tamper with, cover, disconnect, obstruct, move, or disable any authorized security or monitoring device.

Any attempt to disable or evade a device is a material breach and may result in immediate termination.

25. Maintenance Interruptions; Amenity Downtime

Owner does not guarantee uninterrupted availability of every amenity. Pool heaters, spa heaters, fireplaces, fire pits, internet, cable/streaming, grills, appliances, EV chargers, garage doors, exterior lighting, landscaping, outdoor furniture, and similar items may become unavailable due to weather, maintenance, utility interruption, supplier issues, breakage, safety issues, regulation, or prior guest misuse.

Owner may repair, replace, restrict, or suspend any amenity at any time for safety or operational reasons. Unless required by non-waivable law, amenity interruption does not entitle Guest to cancellation, refund, relocation, or damages.

26. Cleaning Expectations

Guest must leave the Property in reasonably orderly condition, including:

  • washing or loading used dishes as instructed;
  • bagging trash and placing it in designated bins;
  • turning off appliances and flames;

Guest is financially responsible for all damage or loss caused by Guest, occupants, visitors, contractors, vendors, invitees, or pets, whether accidental, negligent, reckless, intentional, or caused by rule violations.

Owner’s remedies are cumulative and include direct damages, consequential damages where recoverable, lost rent, emergency service charges, staff time, administrative time, replacement cost, repair cost, and reasonable attorneys’ fees where allowed.

28. Injury; Medical Emergencies; No Lifeguard; No Medical Services

Owner does not provide lifeguard, babysitting, nursing, medical monitoring, rescue services, or emergency supervision.

In any emergency, Guest shall immediately call 911 first, then notify Owner. Guest authorizes Owner to take reasonable action to protect persons and property if Owner becomes aware of an emergency, but Owner has no duty to monitor Guest’s safety in real time.

29. Release and Assumption of Risk

To the fullest extent permitted by California law, Guest knowingly and voluntarily assumes all risks arising from occupancy of the Property and use of all amenities, including but not limited to the pool, spa, pool slide, diving board, decks, steps, wet surfaces, outdoor equipment, fire pits, BBQs, fireplaces, driveways, landscaping, and any recreational or outdoor feature.

To the fullest extent permitted by law, Guest releases and agrees to hold harmless Owner from claims arising from Guest’s or any occupant’s own acts, omissions, negligence, misuse, lack of supervision, intoxication, rule violations, assumption of risk, or unauthorized conduct.

However, nothing in these Terms is intended to waive or limit any liability that cannot lawfully be waived or limited under California law.

30. Indemnification

To the fullest extent permitted by law, Guest shall defend, indemnify, and hold harmless Owner from and against any and all claims, demands, suits, losses, damages, liabilities, judgments, fines, penalties, costs, and expenses, including reasonable attorneys’ fees and costs, arising out of or related to:

  • Guest’s breach of these Terms;
  • injury to or death of any guest, visitor, or third party caused in whole or in part by Guest or Guest’s group;
  • property damage caused by Guest or Guest’s group;
  • pool, slide, diving board, fire feature, or other amenity use by Guest or Guest’s group;
  • neighbor complaints, HOA claims, or government violations caused by Guest;
  • illegal acts, nuisance, trespass, or excessive occupancy;
  • chargebacks or payment disputes by Guest.

This indemnity survives checkout, cancellation, and termination.

31. Owner’s Right to Refuse Service, Cancel, or Terminate

Owner may refuse service, deny entry, cancel a booking, or terminate occupancy immediately, with or without refund as allowed by law, if Guest:

  • violates these Terms;
  • exceeds occupancy or visitor limits;
  • creates noise, nuisance, or safety concerns;
  • uses the pool, slide, diving board, spa, fire pit, or other features unsafely;
  • tampers with safety or security devices;
  • provides false information;
  • causes or threatens damage;
  • violates law, HOA rules, permit rules, or platform rules;
  • fails to timely depart.

Guest agrees to leave immediately upon notice of termination. Failure to leave may result in law enforcement involvement, civil action, lock/code changes, and additional charges.

32. Personal Property; Lost and Found

Owner is not responsible for lost, stolen, or damaged personal property, whether left in the Property, mailed, stored, or discarded after checkout, except to the extent required by non-waivable law.

Items left behind may be stored, shipped at Guest’s cost, discarded, or donated at Owner’s discretion after a reasonable period.

Perishable items, low-value items, and unsanitary items may be discarded immediately.

33. Force Majeure

Owner is not liable for cancellation, interruption, reduced use, or damages caused by events beyond Owner’s reasonable control, including weather, wildfire, smoke, flood, earthquake, pandemic, epidemic, utility outage, public safety power shutoff, internet outage, labor shortage, governmental order, supply-chain delay, civil unrest, strike, war, terrorism, or acts of God.

Owner may cancel or restrict occupancy if Owner determines, in Owner’s sole reasonable judgment, that occupancy would be unsafe, unlawful, impractical, or likely to damage the Property.

34. Insurance

Guest is strongly encouraged to purchase travel insurance, trip cancellation insurance, liability insurance, and medical insurance sufficient to protect Guest and all occupants.

Owner’s insurance does not cover Guest’s personal property and may not cover Guest’s injuries, losses, cancellations, or liabilities.

35. Notices; Electronic Signatures

Guest agrees that these Terms may be presented electronically and accepted by e-signature, checkbox, platform acceptance, message confirmation, payment, or occupancy.

Electronic records, platform messages, ID submissions, timestamps, surveillance footage from lawful exterior cameras, maintenance logs, neighbor complaints, smart-lock records, and photographs may be used as evidence in any dispute.

36. Severability; Interpretation

If any part of these Terms is found invalid, illegal, or unenforceable, the remaining portions shall remain in effect to the fullest extent allowed by law.

Any ambiguous provision shall be interpreted to protect the lawful, reasonable expectations of Owner and to preserve maximum enforceability consistent with California law.

Section headings are for convenience only.

37. No Waiver

Owner’s failure to enforce any provision at any time does not waive the right to enforce that or any other provision later.

Any waiver must be in a signed writing by Owner.

38. Governing Law; Venue

These Terms shall be governed by the laws of the State of California, without regard to conflict-of-laws rules.

Any dispute arising out of or relating to the reservation, occupancy, Property, or these Terms shall be brought exclusively in the state courts located in the county where the Property is located, unless federal jurisdiction applies or non-waivable law requires otherwise.

Guest consents to personal jurisdiction and venue in that location.

39. Attorneys’ Fees; Costs; Collection

In any dispute, collection matter, or proceeding arising from these Terms or the stay, the prevailing party shall be entitled to recover reasonable attorneys’ fees and costs to the extent permitted by applicable law and any enforceable contract provision.

Guest shall also be responsible for collection fees, chargeback defense costs, administrative fees, and third-party recovery costs associated with amounts due.

40. Entire Agreement

These Terms, together with the booking confirmation, platform listing, house rules, check-in instructions, posted safety rules, pool rules, fire rules, and any signed addenda, constitute the entire agreement between the parties concerning the stay.
